Purpose

When a Med-Legal Review Is Appropriate

A med-legal review may be requested to:

  • Identify areas requiring further clinical clarification
  • Provide preliminary opinions regarding OT standard of care
  • Provide preliminary opinions regarding proposed care plans
  • Review therapy recommendations

These reviews can assist counsel in understanding the clinical aspects of a file before proceeding to more comprehensive reporting.

Process

Review Process

Med-legal reviews typically begin with a structured review of the available documentation to understand the clinical and functional issues within a file.

Depending on the needs of counsel, the review may proceed in one of two ways:

Verbal Consultation

In some cases, counsel may request an informal consultation following file review. This allows discussion of clinical considerations, potential future care issues, or questions about existing expert reports.

These consultations provide an opportunity for counsel to obtain preliminary clinical insight before proceeding to formal reporting.

Written Med-Legal Review

Where a formal opinion is required, Mulder OT Services can prepare a written med-legal review.

A written review may include:

  • Analysis of medical and therapy records
  • Commentary on OT standard of care
  • Review of rehabilitation needs
  • Review of existing Life Care Plans or Future Cost of Care reports
  • Identification of areas requiring further clinical clarification

Where appropriate, files may later proceed to a Future Cost of Care report or full Life Care Plan.
